Welcome to the Feegenie.com (hereinafter referred to as website) owned by Feegenie Online Services Private Limited ( hereinafter referred to as company), having registered office located at Above ICICI Bank, Red Square Market, Hisar , Haryana, Pin - 125001. Feegenie Online Services Private Limited is the closely held company incorporated and registered under the Companies Act, 2013.
By using the Feegenie.com services in any manner it is deemed that you have accepted and bound by the following terms and conditions. The provisions of any services of feegenie.com for a user shall be subject to these terms and conditions.
The company reserves the right to modify/amend/add or deletes any of the terms and conditions mentioned hereinbelow any time without any notice or information to the user. The user is requested to keep himself aware with the any of the changes made in the terms and conditions and read & understand it thoroughly.
Definitions
Institution/Association shall mean the person having separate legal entity who uses the platform provided by feegenie.com for collection of any type of fees or sell any products or services through our website and includes the person representing such Institutions/ Associates & Principal Officer thereof.
You/User means a person, firm , company , society or any other legal entity including Institutions. Associates & Payer using or accessing the services of website whether registered or not.
Payer means any person including individual, firm, company, society or any other legal entity whether registered or not using our website for payment directly to the Institution/Associates
1. REGISTRATION/USE
1.1 In using or registering with the Website, You represent that You are of legal age to form a binding contract and are not a person barred from receiving services
under the laws of any applicable jurisdiction, or in the case of a company or other User that is not an individual You represent that You have the capacity to enter into a contract with Feegenie.com. Registration on the website does not imply that the services provided by the website can be immediately used by the user. Feegenie reserves its right to allow the user to use the services upon satisfaction of all other formalities and documentation.
You also agree to provide:
1.1.1 True, correct, accurate, current and complete information about yourself & about the Institution you are representing.
1.1.2 Maintain and promptly update the data to keep it true, correct, accurate and complete.
1.2 All contracts concluded on this website shall be in the English language
1.3 Feegenie reserves the right to refuse or keep hold registration of any User at its absolute discretion.
1.4 Feegenie reserves the right to cancel or suspend the registration of any User at its absolute discretion without any notice or intimation to the user.
1.5 Feegenie reserves the right to restrict the right to use the services of website by user.
1.6 On access/registration on our website user agrees to receive email, telephone and SMS, from our website or its partner website.
1.7 On visiting /use/access or registration on the website the user/Institution/Association agrees that all agreements, notices, disclosures and other communications that are provided electronically satisfy any legal requirement that such communication be in writing.
1.8 User agrees that use of Feegenie is his discretion and he is responsible for maintaining the confidentiality of his account and password. User are themselves responsible for all activities that occur in the user account.
1.9 User agrees that the Feegenie & its associates are authorized to send the SMS/mail to the user and its clients/consumer. Also take responsibility/ownership that he is authorized to use its clients information for sending content/message sent to its consumer.
2. INSTITUTION/ASSOCIATION
About the Institution/ Association that feature on Feegenie:
2.1 Institution/ Associations registered in India can join at the absolute discretion of Feegenie who upon investigation are deemed to be eligible can show a legal structure to our satisfaction will be allowed to register on the site.
2.2 Feegenie shall not have any responsibility for or liability in connection with the activities of Institution/ Association registered with this Website.
3. FEES AND PAYMENT
3.1 User/Payer has agreed with each Institution/ Association registered on this Website that fees, payment processing charges and bank fees will automatically be deducted from every Payment made using the Website.
3.2 Feegenie in not responsible for any loss or damage cause directly or indirectly to the user/payer/ Institution/ Association arising due to :-
Fraudulent activities
Cancellation of transaction
Unauthorized transaction
Decline of transaction for any reason whatsoever
While availing any of the payment modes offered by website and its partners.
4. CREDIT CARD/ DEBIT CARD PAYMENT
4.1 Payer making Payments by Credit card or Debit card hereby agree and assure Feegenie that:
4.1.1 all Credit card or Debit card information supplied to website is true, correct and complete;
4.1.2 the person making the Payment is duly authorized to use the Debit card or Credit card for that purpose and
4.1.3 the Payment and the fees will be honoured by the credit card and debit card issuing company/bank/ Financial Institutions.
4.2 All Payments made via the Website are final.
4.3 The financial information submitted by the payer is directly received by the acquiring bank and Feegenie is not taking receving and storing any information about credit card or debit card.
4.4 Feegenie reserves its right to recover any damages , financial loss, any kind of charges including lawyers fees caused due to fraudulent transactions or fraudulent or unauthorized use of the website or any act or omissions in breach of these terms and condition.
4.5 Feegenie is not responsible for any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the cardholder having exceeded the present limit mutually agreed with the acquiring bank from time to time or declined by the payment gateway acquiring banks for any other reasons.
5. ACCESS TO PASSWORD
5.1 It is up to each User to protect their username and password for use of feegenie. The User is responsible for all activities that occur under its password.
5.2 By accepting these terms and conditions You agree that Feegenie takes no responsibility for fraudulent use of Feegenie account whereby the username and password has been used to access the account.
5.3 If You believe that Your username and password has been compromised and / or is being used by another person, we recommend that You change Your username and password immediately or contact us using the details on the Contact Us page.
6. USE OF YOUR PAYMENT
6.1 Users hereby acknowledge that Feegenie is only a facilitator to facilitate the fees/charges and has no control over the use of Payments which are made to Institution/ Associations registered with this site.
6.2 Feegenie takes no responsibility for Your dissatisfaction with the use of Your Payment to any Institution/ Association and refund of the payment .
6.3 If You are not satisfied use of Your Payment ,You may contact the Institution/ Association directly using the contact details provided on the Website .
7. PRIVACY AND SECURITY POLICY
7.1 Feegenie has laid down a Privacy Policy located at http:/www.Feegenie.com/ privacy policy. The use of site is governed by the privacy policy laid down as abovementioned. This Privacy Policy forms part of the terms and conditions of use of this site, and acceptance of these terms and condition assumes acceptance of the privacy and security policy.
7.2 SMS services are supplied by a 3rd party provider. Feegenie cannot be held responsible for the quality of services provided, including delayed receipt of SMS messages. Users agree to be bound by the terms of service of the SMS provider.
8. USER CONDUCT AND CONTENT
8.1 Users agree to act in a responsible and lawful manner when using the Website. Users shall comply with all applicable laws, regulations and rules and undertake not to use the Website or allow the Website to be used for any unlawful purpose, for the commission of any offence or crime under the laws of any jurisdiction to which access is obtained through the website or in a manner which is likely to cause harm, offence or nuisance to any other Internet user.
8.2 Feegenie reserves the right to review, edit, reject, delete, remove or suspend any material posted which is, in its sole opinion, in breach of this clause, or which it suspects to be in breach of this clause at its absolute discretion. Feegenie shall be entitled to terminate a Users registration for breach of this clause.
8.3 Feegenie expects that the information provided by the user on this site shall not be misleading in any way and reserves to right to delete, remove or suspend any such misleading information.
8.4 The information/data submitted/uploaded by the Institution/Association for collecting fees is its exclusive responsibility and Feegenie is not responsible for any loss occurred to any person/user /Institution/Association in any manner due to wrong or misleading information submitted by the Institution/Association.
8.5 In addition to any other remedies available to Feegenie pursuant to this Agreement, the User agrees to indemnify and hold Feegenie harmless for any losses, liabilities, costs and expenses of whatever nature, arising as a result of breach of clause 8.2.
8.6 We at Feegenie adhere to the rules and regulations and strictly forbid the illegal and unauthorized use of site including and not limiting to posting of explicit forbidden contents , video, sign, logo or trademark, promoting of illegal activities, unauthorized use of copyright material or data, promotion of gambling of any kind,etc.
9. LINKS
9.1 The Website may contain links to the Institution/ Associations registered with Feegenie or the user may be linked through other web sites(Linked Sites). The Linked sites are for your convenience and to access the site or not is upon the judgment of the user.
9.2 Feegenie is not liable in connection with any third party site accessed via a link from this Website, or any contract entered into or through a third party website.
10. INTELLECTUAL PROPERTY
10.1 The Feegenie name and its logo are the assets of Feegenie Online Services Private Limited and may not be used in any way without express written permission from Feegenie.
10.2 The trademarks, copyright and any other intellectual property displayed by Users on this website, including names and logos of Institutions/ Associations registered with the website, may not be used or reproduced without the express written permission of the owners of same.
10.3 The Feegenie website contains Intellectual Property which is the proprietary of Feegenie ("Website IP"). The Website IP includes but is not limited to copyrights and information about technology and may be provided in the form of text, graphic, audio and video downloads, links or source codes. Feegenie retains the rights to the Website IP and reserves all rights in respect of same.
11. CHANGES TO THESE TERMS AND CONDITIONS
11.1 Feegenie reserves the right at any time from time to time to modify or discontinue the website, temporarily or permanently with or without notice. You agree that Feegenie shall not be liable to You or any third party for any modification, suspension or discontinuation of the Service.
11.2 Any user /payer/ Association/ Institution shall be deemed to have understood and accepted the latest terms and conditions as published at the time.
12. FAILURE TO COMPLY WITH THESE TERMS AND CONDITIONS
12.1 Any User who fails to comply in any way with these terms and conditions may at the sole discretion of feegenie and without prior notification, be suspended or banned altogether from using the site.
13. TERMINATION
13.1 Feegenie may terminate Your registration with the Website or your use of the Website without any notice if you breach any of the terms and conditions of this website or any law enforce in India.
13.2 In the event of the use of the site being terminated for any User, that User will still be bound by the terms and conditions of the site in all matters relating to the site.
13.3 Termination deletion, alteration of these terms and conditions for any reason shall not affect the rights of the parties already accrued.
14. LIMITATION OF LIABILITY
Feegenie shall use reasonable skill and care in the operation of the Website. However, You hereby acknowledge that:

14.6 FEEGENIE EXPRESSLY DISCLAIMS ALL AND SHALL NOT BE DEEMED TO HAVE GIVEN ANY WARRANTIES, EXPRESS OR IMPLIED (BY LAW OR OTHERWISE), AND (OTHER THAN AS SET OUT IN THIS AGREEMENT) EXPRESSLY DISCLAIMS AND EXCLUDES ALL TERMS AND CONDITIONS, OR OTHERWISE, IN CONNECTION THIS WEBSITE TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.15. INDEMNITY

16.1 These terms and conditions & agreement shall be governed by and in accordance with the laws of India. Any disputes arising in any way in relation hereto shall be subject to the exclusive jurisdiction of the Hisar Courts.
